Administrative obligations

Foreign employers from the EEA and Switzerland with temporarily posted personnel in the Netherlands must comply with a number of administrative obligations:

Documents available in the Dutch workplace

Foreign employers must have certain documents available in the Dutch workplace of the posted worker (or to have them immediately available digitally). This concerns employment contracts, pay slips, timesheets, A1 forms and proofs of payment. These documents must be available for 5 years after completion of the work. The Netherlands Labour Authority may ask for them.

Disclosure obligation

The Netherlands Labour Authority can request all information necessary for the enforcement of the Posted Workers in the European Union (Working Conditions) Act.

Contact person

Foreign employers must appoint a contact person in the Netherlands who can be approached by the Netherlands Labour Authority and acts as a point of contact. This may also be a posted worker.

Duty to report

Foreign employers are obliged to announce their activities in the Netherlands via the Dutch online notification portal.

Administrative obligations also apply to self-employed persons with a duty to report.

Fine

A foreign employer or self-employed person with a duty to report risks a fine when he does not comply with the administrative obligations under the Posted Workers in the European Union (Working Conditions) Act. For more information, please visit postedworkers.nl.
