Workers who are temporarily posted to the Netherlands are entitled to a number of core conditions from Dutch employment law during the first 12 months of their posting. It concerns the following:
Minimum Wage and Minimum Holiday Allowance Act (Dutch)
Working Hours Act (Dutch)
Working Conditions Act (Dutch)
In sectors where a universally binding collective labour agreement applies, posted workers are also entitled to the universally binding provisions of that collective labour agreement under the Collective Agreements (Declaration of Universally Binding and Non-Binding Status) Act (Dutch).
After 12 months, posted workers are entitled to additional Dutch employment conditions and circumstances, the 'extended hard core'. This 12-month period can be extended to 18 months. A different arrangement applies to agency workers who are posted to the Netherlands: they are entitled to additional employment conditions from day 1 and their employers are subject to additional obligations.
