Foreign Nationals Employment Act

The Foreign Nationals Employment Act (Dutch) contains the rules on employment of persons of non-Dutch nationality: 'foreign nationals'.

People with Dutch nationality or the nationality of one of the countries of the European Economic Area (EEA) and Switzerland have no employment restrictions in the Netherlands. The EEA includes the countries of the European Union plus Norway, Iceland and Liechtenstein. Free movement of workers applies to these countries.

The Foreign Nationals Employment Act (Wav) prohibits employers and private individuals from having foreign workers who do not have free access to the Dutch labour market to work for them, unless they have a valid work permit or a combined work and residence permit (single permit).

Fines and sanctions

The Netherlands Labour Authority monitors compliance with the Foreign Nationals Employment Act by employers. If the Foreign Nationals Employment Act is violated somewhere in the chain of employers, the Labour Authority may impose fines and sanctions.
