Working conditions catalogue assessment

The Working Conditions Act offers employers and employees scope to implement healthy and safe working practices themselves. In a working conditions catalogue, employer and employee organisations describe joint agreements on healthy and safe working practices. New and amended working conditions catalogues are assessed by the Netherlands Labour Authority.

Target requirements

The Labour Authority only assesses the specific implementation of the target requirements. A target requirement is a standard in the law that companies must comply with. The Labour Authority does not assess texts, references and appendices that are not directly related to the implementation of the aforementioned requirements.

Responsibility of the submitter

Social partners are responsible for the design and content of the working conditions catalogue and for ensuring that employers and employees are familiar with it. You can find more information about working conditions catalogues (Dutch) at arboportaal.nl.

Assessment criteria

When assessing a working conditions catalogue, the Labour Authority evaluates the following components. lf something is missing, the Labour Authority will not consider the working conditions catalogue.

  • For which field of work (industry/sector/group of companies) is the working conditions catalogue intended?
  • Do the authors represent the employers and employees in this field of work? (You can demonstrate this by having all organisations sign the letter. This may also be an electronic signature.)
  • Can the working conditions catalogue be viewed (online) free of charge by all employers and employees?
  • Does each measure or provision described indicate which working conditions regulation it implements? You can use the working conditions regulations format (Dutch) for this. All other texts included in the working conditions catalogue by the social partners are not assessed by the Labour Authority.
  • Do the proposed measures in the working conditions catalogue comply with the target requirements of the Working Conditions Act?
  • Do the proposed measures comply with the occupational health strategy?
  • Is the catalogue understandable, logical and not contrary to the law?
  • Does the working conditions catalogue indicate whether - and in what way - special categories of employees such as young people, older people and pregnant wamen have been taken into account?

Submitting a working conditions catalogue for assessment

Procedure for assessing a new working conditions catalogue

  • The submitter is responsible for providing all documents, including those referred to in the working conditions catalogue. The assessment will only start once all documents have been received.
  • The submitter must clearly indicate in an accompanying letter how the assessment criteria have been met. See also the assessment criteria referred to above.
  • After receiving the complete working conditions catalogue, the Labour Authority will send the submitter a confirmation of receipt.
  • The submitter will be informed of the result in writing.
  • Positive assessment: the working conditions catalogue is valid for 6 years after the date of the assessment letter.
  • Negative assessment: amend the working conditions catalogue and resubmit it.

Procedure for assessing an outdated working conditions catalogue

  • The submitter is responsible for ensuring that the content of a working conditions catalogue is up to date. After 6 years, a working conditions catalogue is outdated and its content must be reassessed.
  • 5 years after the assessment letter, the submitter will be asked to have the working conditions catalogue reassessed by the Labour Authority.
  • The (un)changed working conditions catalogue must be submitted to the Labour Authority within 6 months of the request.
  • lf there are any specific changes, the Labour Authority will request that these be clearly indicated in the working conditions catalogue.
  • Positive assessment: the working conditions catalogue is valid for 6 years after the date of the assessment letter.
  • Negative assessment: amend the working conditions catalogue and resubmit it.

Is the working conditions catalogue still up to date? lf so, send the unchanged version to the Labour Authority. We will check the extent to which the working conditions catalogue still complies.
