Sequential Responsibility in the Foreign Nationals Employment Act

A chain of clients is created when temporary workers are hired through a contractor, a temporary employment agency, or a company in the same line of business. This company, in turn, may hire other companies to perform some of the work.

Employers are responsible for ensuring that all their workers are legally employed. Employers have to make sure that foreign workers: have a valid identity document, that they are legally present in the Netherlands and that they are allowed to work in the Netherlands.

This responsibility does not only apply to workers on the employer's payroll. Employers are also responsible for the legal deployment of workers further down the chain. So also in the companies they hire, such as a (sub)contractor, a catering company, a cleaning company. Employers may risk a fine if these companies do not have the permits for the workers in order.
