Request for information Article 10a AVV

Organisations of employers and employees or joint enforcement officers can submit a request for information (Article 10a of the Collective Agreements - Declaration of Universally Binding and Non-Binding Status - Act) to the Netherlands Labour Authority. This information is needed to monitor compliance of posted workers with the collective agreement provisions and is obtained under the Posted Workers in the European Union (Working Conditions) Act.

Information requirements under Article 10a

A request for information (article 10a) must be made on paper and according to the following requirements:

  • The request is addressed to the Minister of Social Affairs and Employment.
  • The request is made by employer and employee organisations involved in a universally binding collective agreement. Or by a legal entity with full legal capacity charged with enforcing collective agreements.
  • The collective agreement has been declared universally binding.
  • Manifestly well-founded suspicion of non-compliance.
  • Period of non-compliance (the investigation period).
  • The applicant must explain the requested data.

Submitting a request for information under Article 10a

Requests must be submitted via contact@nlarbeidsinspectie.nl stating 'Request for Information Article 10a AVV' as a reference.
