There are special rules on working conditions and working and rest times for non-salaried workers.
Non-salaried workers
The Health and Safety Regulations and Working Hours Act do not only apply to employers and salaried employees. The rules also apply to non-salaried (professional) groups, such as:
agency workers
self-employed professionals, freelance workers and independent contractors
Many provisions of the Working Conditions Act also apply to self-employed professionals. It is about the risks to the self-employed professional themselves, but also about risks to others: people working in the same space, customers and passers-by.
Which rules apply to the self-employed professional depends on the type of work they do and whether they work alone or if there are others in the room.
The Netherlands Labour Authority will take action against self-employed professionals who fail to comply with the Working Conditions Act, even if they work alone. The Labour Authority may decide to shut down a self-employed professional's activity and impose a fine as well.
